The inability of the Brazilian Federal Government covers all areas such as social, cultural, public health, economy and education. Economy has become more important than saving lives and the capitalism’s perversity makes a legal struggle among economy areas and public authorities. It is important to discuss the access to Digital Information and Communication Technologies (DICTs) since they are the main connecting resources among teachers and students. Besides, they work as way of implementing a distance pedagogical practice which was imposed by the social isolation. As a central argument, this article seeks to highlight how the public education policies, directed to the COVID-19 pandemic confrontation, don’t take into account the unequal reality of access to the DICTs as well as social, economical and cultural goods of teachers and students from the Brazilian education systems. Therefore, we aim to understand how those emergency public education policies tend to disregard that context inside the national scenario and what are the consequences to teaching and learning.
